Data Policy

This document «Personal Data Processing Policy» (hereinafter referred to as the «Policy») sets out the rules for collecting and using “the Hi People” resource of personal information of users of the site https://hipipl.com  and other resources Hi People.

  1. Terms and definitions
    1. This Policy uses the terms and definitions provided for in the User Agreement, as well as other Agreements concluded with the User, unless otherwise provided for in this Policy or follows from its substance. In other cases, the interpretation of the term used in the Policy is carried out in accordance with the current legislation of Kazakhstan, business practices, or scientific doctrine.
    2. The following terms and definitions are used in this document and the resulting or related relations of the Parties:

      • User (You) – the person who visits or uses the resource “the Hi People”.
      • Agreement – an agreement on the gratuitous use of a resource “Hi People” concluded between the User and the Copyright Holder on the basis of a user agreement posted on the Resource’s Website “Hi People”.
      • Resource “the Hi People” or Hi People – Internet resources available on the Internet at network addresses: https://hipipl.com, https://vk.com/club114256136 и https://t.me/Couch_RoBoT
  1. Personal information
    1. Personal information in this Policy means:
    2. Information that can be associated with a specific User, including name, address, phone number, email address, as well as information about the User’s actions in the Hi People and other similar information. The Copyright Holder processes Personal Information, including the User’s personal data, which the User provides about himself independently, including using the keyboard bot in VK and telegram and other forms of feedback in the Hi People, as well as during registration or authorization.
    3. The data that is transmitted automatically, depending on the User’s software settings, is anonymized. Anonymized data may include a unique device identifier (permanent or non-permanent), an environment access control address (MAC address), an international mobile device identifier (IMEI), name, model and other information about the device used, IP address, information about the communication network, location (country, region, city), information about the browser, the source of access to the Site, information about the operating system, information about the time and frequency of visits, statistics of actions on the Site, information about information transmitted and received using the Application and materials, as well as geolocation data, if the corresponding function is enabled on the User’s devices. The specified information is impersonal (anonymous), there is no data in it that allows it to be attributed to a specific User. Depersonalized information is processed separately from Personal Information and cannot be combined with it. Anonymized data may be collected and/or processed using third-party software and/or services, such as Google Analytics, Yandex.Metrica, and others.
    4. The Copyright Holder has the right to establish requirements for the composition of the User’s Personal Information, which must necessarily be provided for use by the Hi People or its individual functionality by specifying such information in the Hi People. If certain information is not marked as mandatory by the Copyright Holder, its provision or disclosure is carried out by the User at his discretion.
    5. The Copyright Holder does not verify the accuracy of the Personal Information provided and whether the User has the necessary consent to process it in accordance with this Policy, believing that the User acts in good faith, prudently and makes all necessary efforts to keep such information up to date and obtain all necessary consent from the subjects of personal data.
    6. The Copyright Holder does not intentionally collect Personal Information from children under the age of 14. Persons under the age of 14 are prohibited from providing personal information to the Copyright Holder, in particular, name, address, phone number and email address. If the Copyright Holder becomes aware that information has been collected from a person under the age of 14, the Copyright Holder will immediately delete such information.   1. Purposes of Personal Information processing
    1. The Copyright Holder has the right to use Personal Information exclusively for the performance of the Contract concluded by the Copyright Holder and the User and the conclusion of contracts with the User for the following purposes:
  1. Providing the opportunity to use the Hi People;
  2. Conclusion and execution of an Agreement with the User;
  3. Identification of the User as part of the fulfillment of obligations under the user Agreement concluded with him;
  4. Information service for the User, including providing responses to User requests using feedback forms, etc..
  5. Dissemination of information about the user to third parties in accordance with the procedure established by this Policy and the User Agreement. In particular, the distribution of the name, links to social networks, approximate location, photo and text specified during the publication of the announcement.
  6. The Copyright Holder has the right to provide Personal Information to third parties with whom the Copyright Holder has concluded contracts, in cases where this is necessary to fulfill the obligations of the Copyright Holder to the User, as well as in other cases related to the User’s use of the Hi People, within the framework of the above-mentioned purposes.
  1. Requirements for the protection of Personal information
    1. The Copyright Holder stores Personal Information and ensures its protection from unauthorized access and distribution in accordance with internal rules and regulations.
    2. With respect to the User’s Personal Information, its confidentiality is maintained, except in cases where the technology of the Service provided or the settings of the software used by the User provide for an open exchange of information with other participants and users of the Internet.
  1. Transfer of Personal Information
    1. The Copyright Holder has the right to transfer Personal Information to third parties in the following cases:
  1. The User has expressed his consent to such actions, including cases when the User uses the settings of the software used, eliminating the restriction on the provision of certain information;
  2. The transfer is necessary for the purpose of fulfilling this Agreement as part of the User’s use of the Site’s functionality;
  3. In connection with the transfer of all or part of the Rightholder’s assets to the possession, use or ownership of a third party, including the assignment of rights under contracts concluded with the User in favor of such a third party;
  4. At the request of a court or other authorized state body within the framework of the procedure established by applicable law;
  5. In order to protect the rights and legitimate interests of the Copyright Holder in connection with the violation of the agreement concluded by the user.
  1. The Copyright Holder does not process, including transfer (distribution, provision, access) of personal data that is not authorized by the User for distribution
  1. Changing Personal Information
    1. The User has the right to edit or delete the Personal Information provided by him during registration or authorization in his Personal Account at any time, if such functionality is implemented in the Hi People.
    2. At any time during the entire period of using the Hi People, the User has the right to delete personal information posted on the Rubber Bot, except for reviews about other users, by sending the Copyright Holder a corresponding statement on the destruction of Personal Data in writing or in the form of an electronic document certified by a simple electronic signature of the User. After deleting personal information, the service will continue to provide previously received feedback, but the user’s personal information will be deleted (name, age, photo, location) and moved to the archive (social network IDs).
    3. The User has the right to revoke consent to the processing of his personal data at any time by sending a corresponding application to the Copyright Holder in any way using the contact details of the Copyright Holder posted on the Website. The application for revocation of consent to the processing of personal data must comply with the requirements of the current legislation of Kazakhstan. Upon receipt of the relevant application, the Copyright Holder has the right to process the User’s personal data exclusively in accordance with the procedure and in cases provided for by the current legislation of Kazakhstan.
  2. User’s consent to receive information from the Copyright Holder
    1. By providing the Copyright Holder with an e-mail address, links to social networks, or a phone number when filling out any form in the Hi People, you agree to receive from the Copyright Holder by e-mail, in messages, or by telephone (SMS), respectively, information related to the use of the Hi People, as well as other information from the Copyright Holder, including advertising character. You can opt out of receiving this information at any time by following the instructions on the link in the message, or by writing to the Copyright Holder by e-mail.
  1. Changing the Personal Data Processing Policy
    1. This Policy may be changed or terminated unilaterally by the Copyright Holder without prior notice to the User. The new version of the Policy comes into force from the moment it is posted in the Hi People, unless otherwise provided by the new version of the Policy.
    2. The current version of the Policy is posted on the Website and is available via a permanent link on the Internet at https://couchbot.org/privacy.
